Ed Sheeran will have to face court over claims he copied Marvin Gayes hit, Lets Get It On.

The 27-year-olds bid to request a lawsuit over his own single, Thinking Out Loud, has been rejected, meaning a jury will decide whether or not he is guilty of copying the song, which was released in 1973.

It has been reported District Judge Louis Stanton said there were substantial similarities between several of the two works musical elements.

According to BBC, his defence team has argued Thinking Out Loud includes sombre, melancholic tones, addressing long-lasting romantic love, while Lets Get It On is regarded as a sexual anthem.

However, Judge Stanton has stated listeners could see both tracks having the same aesthetic appeal.

He also said jurors may be impressed by footage of a Sheeran performance which shows him seamlessly transitioning between both songs.

The action was brought against the Dive star by the heirs and estate of Ed Townsend – who co-wrote Lets Get It On with Marvin.

Judge Stanton is also presiding on another lawsuit alleging Ed Sheeran copied Lets Get It On, with Structured Asset Sales (SAS) – who own a third of Townsends estate – suing the singer for $100million (£76.4million).

They claim he ripped off the melody, rhythms, harmonies, drums, bass line, backing chorus, tempo, syncopation and looping of the classic song.
